debt from 3/97 new CA

    RJM is requesting payment and I am wondering do I need to send them a validation letter since they say the last payment was from 3/ 1997?
    In Texas the SOL is 4 years and so they can't do anything on that end, but can they put it on my hubby's cr?
    I was looking at validation or cease and desist if they have no options.
    Any advice? I haven't pulled his reports yet to see if they have reported, surely its against the law this being a debt that is 9 years old?

    If it went delinquent in 1997, they can't legally put it on a CR, since it is past 7 years, nor can they legally threaten to do so.

    Although they say the last payment was in 1997, do your own records say that?

    If you are in Texas, you might request validation, which they must provide within 30 days to comply with Texas law, to pin down what debt they are claiming to be collecting, and if they provide it, send a cease and desist.

    If they fail to provide it in 30 days, they may have violated Texas consumer protection laws, so if they continue collection attempts with no validation, you may be able to use that against them as well.

    As usual, all communications should be sent CRRR.

    thank you. I dont really remember if the debt is legit, I remember having an account with fingerhut (yes, fingerhut). Will take your advice.
