Okay, First of all I was improperly served as I never received any papers. Late last year around November when my bank accounts had a levy placed on them. So the total judgment is $863 from capital one. What should I do if I want the judgment off my credit report ? its only showing up on transunion.. What can I do or what should I do ? Was the address they served the papers to incorrect? Did someone that knows you accept service on your behalf? If it was sent to an old address, that you are unsure of who lives there now, you'll need to file a Motion to Vacate Judgment (or something to that affect). You'll need to state that you were improperly served, and provide proof of where you were living at the time of service. That will cause the matter to be heard infront of a judge who will decide the matter, if the judgment is vacated, the bank garnishment will go away, however, be prepared that if you don't pay Cap1, they will turn around and serve you papers for a new lawsuit, and do the same thing with.
