Del Lttrs received Should I SUE?

    Hi, First time poster but I have watched the board for a very long time and this board knows what they are talking about helped me greatly with my credit. Okay here is my deal Bank of America was reporting an account I never opened on my credit report that had tons of late payments and bad information. I wrote them and they checked it out and I received a deletion letter from them on Sept 28th 05.....i know amazing a letter of deletion stating they would remove for sure in 90 days. Before I got that letter on the 28th I had also filed a suit with the State Attorney General of Virgina and on Nov 7th I got yet another letter of deletion from Bank of America and copy of the previous deletion letter. Here is the issue though they still have yet to delete it and they are still reporting on the account further ruining my credit and making it so i cannot get a loan. So this is still totally messing with my credit. Its April 7th of 06 now well over 90 days I was wondering do I have a good case of the OC furnishing bad information under the FCRA and also a libel suit??? Should I just go to small claims court for this or hire a lawyer and sue them for alot more. I also did request the information to be updated from the three CRA's and they validated the info from Bank of America. Need help any thoughts would be great.

    Before I would sue, I would send dispute letters to the CRA's listing the bad info. Just see if the info comes back verified or if it gets deleted. If it does come back verified, then you may have fortified your claim to the court that the OC is willfully negligent. If you include copies of the deletion letters with the dispute to the CRA's and the info comes back verified, I would think that you also have a strong case against the CRA's.

    One other thing, just a comment really. Isn't it just ridiculous how they will make you wait up to 90 days for a deletion that is valid????!!! What gives them the right? That is why I do not mind seeing these guys getting sued.
