I've got a CH 13 that was filed in 9/94 and dismissed in 11/94. I didn't care for the advice (or lack thereof) the attorney as giving me. Actually, as I remember, she was pissed because I was asking questions and I think she felt threatened. At any rate, I didn't go through with the BK. Anyway, I seem to remember reading somewhere that, as a matter of policy, the CRAs will usually delete BKs at the 7-year point, even though they are supposed to stay 10 years. Has anyone had any success getting dismissed BKs deleted?
Chapter 13's as a practice are usually deleted at 7 years. You could probably dispute it now as obsolete and have it removed as it is only a few months away. FYI, I had a similar situation where I filed a 13, but never paid the filing fees as I decided against it. Equifax and Exp. deleted it immediately. TU I had to fight and fight with.
A CH13 that has been successfully discharged is removed at the 7 year mark. But if it's dismissed it'll remain for the full 10 years. LKH's got removed because it was apparently never "confirmed". But certainly try.

Hmmm... Perhaps I was wrong. I was wrong once before ya know. ~ Actually at some time during the lengthy explanations about BK's from our very own CLC she discussed this in detail. She was an EXCELLENT resource.
clc was relaying quoted sections from the FCRA and her interpretation of them, hers only -- IF she was someone you could discuss things with, she might have considered that the CRAs treat C13's differently and they do so to encourage its use over a C7. I didn't mean anything by that LKH. Now that I think about it tho, I think it may have something to do with WHY it was dismissed. Like not paying a fully confirmed case. The fact that a CH13 is deleted at 7 years is a courtesy (the actual law still says 10 years) agreed to by all 3 CRA's through the CRA Association. It's a reward for paying off the 13 successfully. It would defeat the purpose if they delete at 7 even on a dismissed plan for nonpayment. See what I mean? And that's not to say that flukes don't occassionally happen.
I know. I was just saying I meant nada. She was just IMO, too taken with herself. She probably isn't posting any longer because of that situation.
It wouldn't necessarily defeat the purpose, Butch dude, if dismissed for non-payment because those cases are usually converted into C7's. If converted, I'm guessing you'd have one listing for 7 years the other for 10; not to mention whatever status the individual tradelines get. I was surprised to find out that most C13's aren't discharged, I don't have an official source or stats or anything official, just based on comments and reactions from Mr. Sassy and I trying to re-establish some credit -- the lender's we've talked to say that most filings are converted and not dismissed for non-payment, that it's rare to find someone that actually pays one off. They know the credit reports are inaccurate, I wonder how much their assumptions factor into report analysis? On second thought, maybe I don't wanna know ;-)
