I have an account with Target that is past due and is getting ready to be charged off. Has anyone ever had any success with getting them to delete? Also, I talked to the Minnesota State Atty. General, who said that sometimes RE's are valid in Minnesota (where Target is based). I've read that on the app target disclaims RE's but I have an app and can't find such a statement. Help anyone?
It's in the full terms of the credit card. The statement loosely says that they can ignore any restrictive endorsements, and accept any payments received, without waiving their rights.
Getting a PFD is hard... Getting a PFD on a LIVE account is next to impossible... And, unfortunately, did you think that you may have given them an incentive to believe that you would be a good target for a lawsuit, by telling them that "Hey, I got the money to pay you (or can get it)."
Never thought of that. Iâ??d be shocked if they would sue though as itâ??s only a $150 debt. What would your next suggestion be? DV it? Do a c&d or maybe letter of goodwill?
I would write up a goodwill letter and ask them to change the report to positive.Then pay them in full before it charges off.
Just because its a small amount, doesn't mean it won't be bumped up to litigation. Especially with Target, I've seen where there second attempt to collect was with a law firm; and this was on a DISPUTED DEBT, which hadn't been validated by the previous CA. And if they sue, $150, won't be $150... For example, tack on possibly $250 for preparing the suit, filing fees for your local court, which could be $50-$100 min, then they'll ask for the lawyers fees for the work above and beyond the preparing of the suit. Try goodwill like cajun said, I just want to bring up the worst case scenario, one thing that I've learned is that you need to learn some "Game Theory" to be able to try to predict the possible outcomes at every stage in the process. When you can be prepared for the possible end-games you're staying one step ahead of your adversary.
