Deletion letter but EQ won't delete

    I have a collection with Park Dansan for Sprint long distance. I paid Park Dansan and they faxed me a letter that the account is paid in full and that they will request deletion on this account with all 3 Credit
    Bureus.

    My account is in legal and I faxed the letter and she stated she will take care of the changes. The only changes she took care was the paid in full not the deletion of the account.

    Since they requested that the account be deleted doesn't it have too. I think I'm getting the wrap around with Equifax. Somebody please help me with my problem.

    This is the exact wording of the letter about the Deletion.



    "Please be advised we have taken the necessary steps to request deletion on the account referenced above from all three national credit reporting agencies, Transunion, Experian and Equifax."


    I'm not sure what you are saying. Do you think I'm not telling the truth or What???

    Send it again and say something like "THEY WANT IT REMOVED...YOU MUST REMOVE IT"

    "I DON'T WANT TO HAVE TO DISCUSS THIS IN SMALL CLAIMS COURT...IT WILL WASTE MY TIME AND YOURS"

    SEE WHAT HAPPENS..

    I have been in so many arguements with this lady! She just doesn't care. I already threatned them before, that is why my account is with the legal department.

    I am so upset, I just want to file in small claims on Monday just to piss them off. I have a letter stating the Collection Agency wants it deleted. Maybee if I really sue them I can get the other negatice account off.

    What do you think?

    1*Just because they gave you this letter it don't mean that they ever said anything about it to the CRAs.Had they done so it wouldn't still be on the reports.

    First of all, are you on the CRA's side on the consumers side?

    Second, I just got the letter on Tuesday and immediately faxed it to them. I had 2 letters from different Collection Agencies. One they deleted and one they updated to Paid.

    Third, The CRA must update provided enough evidence.

    What does everbody else think?

    I think he's just saying that the CA might not have yet done what they say they have done (in taking the necessary steps to have the account deleted). Highly possible when dealing with a CA.

    Maybe you could also contact the CA and ask what they have done or a copy of the UDF and explain that for some reason the CRA is not deleting as requested?

    Assume for a moment EQ received the UDF. You haven't given the wheels enough time to turn. CRAs don't stop what they're doing just to service your needs (not trying to be smart). I suspect that they receive thousands of requests weekly. I would be patient for a while.

    Exp made me wait the full 90 allowable 90 days to delete once they recieved the CA's udf to delete.

    EQ has been pretty good to me in the past with deleting based on a CA's letter to delete.

    Try faxing it to EQ stating they need to delete becasue of an error with the account and send them the CA's letter to delete.

    I'd keep pounding the fact that the account is not yours, if you haven't already told the CRA something else.

    That letter... I know your showing us a snipit so I'm wondering this. In the letter from the CA, does it say anything about you having made full payment and because of that they will request deletion? If it does say that, the CRA will not delete it because it's accurate info. The letter you need from the CA needs to say something in line as to the CA making a mistake and the account not being yours.

    FULL STOP SCORGUY !!!


    First, try not to be too defensive. We know you're frustrated. So are we. That's why we're all here.



    CrabJoe just hit the nail on the head. Within their contract between CRA and CA, it's clearly stated that the CA will NOT attempt to have deleted an accurate account listing just because the debtor offers payment. With this in mind the CRA is probably telling everyone to shove it because, since the letter itself confirms the existance of the account, the TL is accurate.


    What you should have done (hindsight being 20-20) is get a UDF with the notation "Submitted in Error).

    Try going back to the CA and getting a copy of the UDF.

    Beyond that, we're ALL gonna have to put on our thinkin caps on this one.

    The rest of the letter states this:

    "Please consider this letter as confimation that our records indicate the account referenced above is paid in full.

    Original amount of collection $327.75 Date paid 6-3-03"

    The account is really not mine. I just paid it so they can delete it. Park Dansan is the one that reports the information. Equifax takes in the information from the Collection Agency. If Park Dansan says delete it, then they should delete it or face a Lawsuit.

    Ok well .... that's one of the directions I was thinkin.

    Right now you have no grounds for a lawsuit so take a deap breathe and lets figure this out.

    Just a suggestion, but I've had a lot of luck with contacting Equifax's consumer affairs division. Robin Holland. I've faxed and emailed her to get things taken care of. Both times, they have gotten back to me the next day.

    We know Vicki. She can be both an angel and the devil "herself". lol


    There's nothing new about a debtor paying a debt which is not really legitimate just to get it off their report, especially when the amount is small, and 350 bux qualifies.

    Frankly, I myself have paid a $200 one just to get rid of it, best 200 bux I ever spent, but that's another issue. lol
