I have a charged off acct nearing 7 yrs. However, the bank continues to report it will stay on my credit report til 8/2003. Let me give you a little history. 2/15/01 -I contact to Collection Agency requesting proof of the debt, including the contract or other instrument bearing my signature. I then disputed the claim with the credit bureau They reported back creditior verified - info stays the same. The collection agcy however dropped off. At the time I could call the bank and listen to a recorded mess that stated my last payt was recd on 12/30/94 which happens to be correct. This was my last payt made on this acct. 4/20/01 - Certified ltr was sent to the bank requesting proof of this debt, including the contract or other instrument bearing my signature and my credit history for the past 7 years. I also stated under the Fair Creidt Reporting Act I am entitled to this info within 30 days. ------NO RESPONSE. I contacted the CRA again and explained they may be using the date they sold the account or the date they charged off the account but the date of my last activity was on 12/30/94 which means this should fall off my report in 12/01 or 1/02. Right? 10/15/01 - CRA reports back verified, remains the same. 10/15/01- Contacted the bank again. To old they no longer have any info. The acct was sold. I could request credit statements. So I have and am awaiting a response. In the mean time the CRA told me credit statements are not enough. I am at my wits end. What do you sugguest my next move to be short of filing a suit. It just sounds like it will be a lot of work and I want that to be my very last resort.
Filing a suit is not that much work, and it will get you an easy $1,000 for each violation. The paper wrok is fill-in-the-blank, and you probably won't even have to go to court. They will call you and make you an offer. You can wuote the section fo the FCRA that says that they have to accept proof from you. They are all on drugs BTW
