Did I dig myself into a hole ???

    Hello Everyone

    I sent this letter to (they were collecting for Household ) Capital One a month before I found this site . They didnt respond but out of nowhere RMA sent me a letter stating they are collecting for Capital One . Is it too late to a send a validation letter ? And to declare that this is not my account . Can someone point me to the threads or letter I need to send . By the way this account is 5 years old .

    Actully its not mine. its my mothers account under my name ( if you have been reading the boards you'll hear about my crook mother )

    Did I just tell them this is my account ?
    What can I do ?





    Due to death in the family last month, I have been made responsible to take over other pass due credit accounts besides my own. To keep me from completely destroying my own credit I would like to settle my debts with you the best that I can.
    With this letter, I offer to settle my outstanding debt with you for 30% of its total amount. I am offering you 938 to be paid in 12 monthly payments of As long as I stick to these payment terms, you agree to both delete all derogatory credit or report as unrated to the major credit bureaus and report this account as current and satisfactory.
    If this is agreeable to you, please send a payment schedule, along with a letter confirming our agreement.
    Thank you for allowing me to clear up this pass due account.

    Send Validation letter. Its not yours. Period.

    You can try the validation, and if I was in this situation, I would, but as for your question, yes, it looks like you told them it is your acct. Hopefully, they didn't keep it.

    Also, it was previously stated that "unrated" ha a negative affect on your credit score.

    I posted a long one on your other thread "my mother is a crook"...I would hope that you would go back and read it.

    Morally your mother doesn't have a foot to stand on here...but she IS your mother...remember "to err is human...to forgive is divine"

    Deny, Deny, Deny......Validate, Validate, Validate....It's your Right!

    Also dispute tradeline with CRA once CA is in receipt of validation and dispute letter.

    If CA verifies with CRA before the validate with you, you then have the CA on a violation of the FCRA and FDCPA. You can then settle for deletion instead of your suit against them for their violations.

    It has worked for me and continues to work.

    Back up....

    You claim that because of a death on the family YOU are now responsible for some extra debts?

    How is that? Are you a co-signer? Was it your spouse that died?

    Otherwise, the deceased's estate is responsible for the debt. If the estate is not large enough, then too bad. The creditor is outta luck.

    Don't let a creditor convince you that a family member is responsible. They are not. Some CA's and creditors will lay a guilt trip on family members to get them to cough up money for a dead family member's debt.

    So, how about clarifying that small detail?
