Before I knew anything about validating with a CA, I began making payments. I did this on my own because I knew it was a medical bill--and it was mine. Everything was going "ok" since September of last year-making payments each month. I had no real contact with the CA--they left me alone. Then, out of the blue a week ago I get a call from another CA wanting to collect on the same bill. I stated that I thought it was being collected by XXX Collection agency. They said that I had missed a month (which is not true) and therefore assigned it to them to collect. I told them that I would continue to make the payments--they said that would be fine if I increased the amount. I said "ok". I could have kicked myself. I have NO letter from them in the first place. SO...as of this minute I am waiting for the rep. to return my call so that I can tell him to send it to me in writing. Did I screw up by "agreeing" to pay? If this was recorded, they didn't tell me ahead of time. Think I will get anywhere by telling them that they are required to send me notice 5 days after 1st contacting me? If I get such a notice, I plan on sending them a validation letter.... Hoping I didn't screw-up, Mrs. C "No more Mrs. Niceguy"
I'd say so, but no point in kicking yourself you didn't know any better. First thing is first, stop sending them money and fire off a validation letter. Depending on your situation you may also want to try and negotiate a settlement for deletion. If they have really po'd you, study the heck out of the FDCPA and this board. Then sue them in court for violations.
Update... The CA said... Sure, we'll send you a letter--demanding the full amount. I sent off a validation letter CRRR. I dunno if it will work or not--they say that they sent me a letter in June and several since. They have not. The first time I heard from them was via the phone a week ago. When they said that it was *just* turned over to them. Ugh. Mrs. C, staying strong.
