I am new and am not sure if I screwed myself or not. I disputed with the CRAs an old (charge off of 07/1996) charge off as being part of a 1995 BK. It came back verified. I also received a collection letter asking for the balance and noticed that on my reports it now shows as a collection. I sent a letter to the CA saying it was part of a BK in 1995 and should be removed. No response. My question is this - by sending the first letter to the CA saying it was a BK in 08/95 and it should be removed effective 08/2002, did I screw everything up by already communicating it was part of a BK, making the validation uncessary??? My thinking is that regardless, they should still validate it and I want to send the validation letter now. I have heard of people making payments on a collection account and then sending a validation after the fact. May be stupid - living and learning, but advice would be appreciated. Since it's from 1996, it's highly unlikely they can validae it.
On other important note - I "thought" it was in my BK but it is in there as being "reaffirmed", meaning I wanted to keep the account. They closed it of course but technically it really wasn't part of the BK. The original deliquency was in 1995 though, not 7/1996 as they say it was..... Thank you!!!
Also, anyone correct me if I am wrong, but since it is from 1996 shouldnt it be SOL and not collectable depending on what it is?!?
They say DOLA is 07/1996 but the "original date of delinquency" was 08/1995 as I was prepared to flush it in the BK. It's a gasoline card. I know the SOL is over with so they can't sue me but I need it off this year when it should have come off. However, I have read that charge offs pre 12/97 don't have to adhere to the "original date of deliquency" rule - they can show the DOLA as the charge off date, which I guess was 07/1996. Any input is appreciated
