did I shoot myself in the foot??

    I recently sent off validation letters for all 5 things on DH reports.One was a paid medical that I sent validation,hoping for something.(not showing paid on all three reports.) I know now I shouldn't have sent them anything after reading Why Chats follow up for hippa...... but anyway the letter was a combination validation,nutcase,hipaa compliance combo!
    Today I received a letter from CA that says:

    you haved addressed numerous objections in your letter.The only clarification given as to the nature of your dispute is the possibility of erroneous information....blah blah we'll do the best to try and interpret your letter.It appears you deny receiving the services....please state this in future correspondence.
    Our records indicate we received payment.Blah..Blah. It would be necessary to review each of the credit reports to determine of any info was inaccurate or not updated.By requesting a report an inquiry notation would appear on your history and this alone could be construed as a negative remark. To dispute the negative tradeline with the appropriate credit bureau will give you the desired results of having only accurate and up to date info on your credit report.
    Blah Blah all the dates they tried to send letters.
    Your request for validation has expired however,we will supply you with a copy of your signature as soon as we receive the documentation.
    Enclosed a final copy of hipaa rule.....highlighted the section that says the section specifically excludes your request for an accounting disclosure since the provider was not required to be in compliance until april 14....blah blah we are not required to disclose the content of our contracts or agreements to an individual.
    blah blah cant delete accurate information.
    we send my a signature relating to the date of treatment as soon as we receive the information from our client
    signature
    This is an attempt to collect a debt. Any information obtained will be used for that purpose
    Enclosed was an itemized list for services
    Help did they screw up at all...what do I do next??
    Help anybody!!!

    Since YOU instigated the exchange of information request with the CA, they are NOT in violation of any of the HIPAA privacy rules by responding.

    I did not think the instructions on the letter to HC providers was all that complicated.

    The principle was simple, if you disputed to the CRA, the CA should not have been able to verfy, as it would have been a HIPAA violation.

    Since you decided to throw every type of dispute and "validation" into the mix, you destroyed the legal premise of the letter by communicating with the CA.

    I have no idea WHAT anyone would make of this mess now.

    Don't despair Mama,

    We'll think of something. LOL

    Is the TL being reported by only the one entity, the CA? Or is the OC also reporting?

    How much was it for?

    When did you make the payment? When did it first charge off?


    It's a good thing that they suggest that they cannot make hide nor hair of your complaint. Yes, you went waaaaay overboard, but in this case the more overboard you went the more in your favor it will be.

    Here's why: If they can't make sense out your complaint that provides you with an opportunity to provide clarification. Suppose you sent your complaint in Japanese. Believe me they'd send it back, thus providing you another chance to complain again, IN ENGLISH this time. That's exactly what their letter says.

    Your approach now can be, "Good, since you couldn't read my last letter, as clear as it was, what I meant is ... blah, blah, blah".

    We just need to think of what to say in the "blah, blah, blah" part. LOLOL


    Which really ought not be too difficult. I've always maintained that pd collections have the best chance of getting deleted, which I assume is what you're after. Once the acct. is paid they really have no motivation to argue with you. So argue with them we shall.

    yeah I was pretty sure I screwed myself..thanks for letting me know for sure..LOL.... a 1 year old will mess with all the common sense you were born with...Joking aside is there any help for me now???
    The collection is being reported only by the CA for 228 dollars paid/collection unpaid/collection on 1 report.
    Was sent to collection in 2000 was paid recently 1/03
    Thanks for any encouragement I could use it thanks.

    well I had sent the same letter for another CA....I checked today and they deleted from all 3 reports. They must think I'm a nut =).Still not sure what to do about the other??
