Here's my situation. This bottom feeder from a CA got the phone number of my parents (I live in NC, they live in WA) I can only assume from the personal references I just filled out a week and a half ago when I purchased a new car for my wife. He has left several messages (one a day since Friday) stating His name is ABC from XYZ bottom feeder collection agency calling about my discover card. He stated that his company purchased the debt and was calling to offer a generous settlement and avoid credit problems. Isn't it illegal for them to call and give information other than their company and call back information? I think I read somewhere where it violates the FCRA to tell any information to anyone other than the person it's about. When Sears was calling my home, they wouldn't tell anything at all to my wife, just asked to have me call them back. I was planning on calling this bottom feeder back (tape recorder connection) to find out why he's harassing my parents whom I don't live with when they would have also gotten my current phone number from the same credit application? Also, I know that the XYZ company has my current address, since I've recieved the "You owe us for the Discover card" letter. Thanks in advance for all your great replies.
Re: Did they violate the FDCPA? I'm reading the Fair Debt Collection Practices Act and in section 804 it states § 804. Acquisition of location information [15 USC 1692b] Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall -- (1) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer; (2) not state that such consumer owes any debt; (3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information; He clearly said to an answering machine, that he would have information that it wasn't mine, that he was calling about a settlement for a debt. He also left the same message many times, so would that also violate part 3 of section 804? How should I approach this bottom feeder. Any replies from someone who's had a similar situation would be appreciated. Thanks, Chris
