If a student loan guarantor sells (assigns) a defaulted student loan to a private for-profit collection agency, isn't that loan now just like any other dischargeable loan that can be included in a Ch. 7 BK? I read on Butch's CA site that SallieMae has purchased a collection agency. Is that possibly why? So that the ca will be a governmental unit? Just wondering.
Well, I spoke with a friend of mine who is an attorney, and who during law school clerked for a BK judge. I had the same question you did! She told me that no, unfortunately those still will not be dischargeable because they are still going to be listed as student loans by the CA. Boo! Hiss!
