Discover card fiasco..pls help!

    Please advise. I've written to Discover three times, 30 days apart, disputing the account and requesting written evidence of a contract CMRR. They have provided nothing.

    I've disputed it with the CRAs at least three times and of course it always comes back as verified. I broke down and called EQ to ask if I could fax copies of the documentation requests. They said they could not accept any documentation--the letters and CMRR cards/reciepts--from me as evidence that the account is not mine. They say that Discover is reporting the correct name and social security.

    Do I send an intent to sue to Discover? Why would they not pay attention to 3 lawful requests for removal or provide documentation?

    I'd be so grateful for any advice on my next step. I'm stumped. Thank you, Kristine

    Did you open this account or was this a fradulent account? You didn't say, so I'm assuming this is not your account, and opinions will be given under this assumption.

    Why doesn't that surprise me...It's good they have provided nothing.That's violations that you need in order to prosecute in court.

    Of course the CRA is going to verify that the account is there! That's where you hammer them by saying "Aha! How can you verify something that isn't valid?" Then you threaten to sue EQ because you have 3 documented letters to Discover, with no response.
    ABSOLUTELY. Get their attention for not paying you any! Attention, that is.

    Thanks for your reply. Regarding EQ: since CRAs are only required to verify with info such as matching names, addresses and social securities #s, how is EQ in violation of anything? Discover keeps providing them with enough matching evidence when they go to verify. What kind of case would I have against EQ?

    Regarding Discover: I need to send an intent to sue and/or actually get moving on that. There is no longer an intent to sue letter in the sample letters, and none of the links I searched provided any samples. Do I just reference their violations of the FCRA, etc? Thanks, Kristine

    When was the account opened, is it current or reporting as negative, and when was the last payment? (i.e.: How much damage is it doing you?)Do you think this is a fraudulent account, or misidentification by Discover?
