I called up Discover who had a new BT offer that would save me about $50 per month. I asked the CSR how much I could transfer, and she told me I could transfer my credit limit minus $50, which is the BT fee. ConsumerInfo.com sent me an alert the other day that showed that Discover placed a mark on my CRs saying "Over Limit." I looked online today at my recent activity, and I was indeed charged $35 for going over the limit. This would be the first statement I received since the BT. It seems quite backwards that a CSR wouldn't warn about this, doesn't it? Do I have any rights under FCBA?
Well, I'm sending a letter today to Disc (via certified mail return receipt) asking that they remove the over limit fee and derogatory marks on all credit reports, citing that I didn't receive a statement until after I was charged an over limit fee. The fee was unfair, and I paid $100 immediately after receiving my statement in order to bring the balance down. I guess we'll see what happens.
