Discover reinsert!!!!

    My DH and I have been diligently sending our VAL ltrs. We have several TL's past the SOL in our state. However, he disputed Discover TL that was due to come off in Oct 2005. Now it is reporting as current and open as of Feb 2005! How can they do this?!

    Would appreciate any help or suggestions.

    We have sent another dispute to all three CRA's and the following ltr. to Discover.

    Dear Discover,

    You are inaccurately and incompletely furnishing information regarding the above-referenced account to the CRA's in violation of the reporting requirements of the FCRA, Section 623, Responsibilities of Furnishers of Information, and for which you are responsible.

    I dispute your information in its entirety and request evidentiary documentation that substantiates the information you have furnished and its reporting.

    Should you not be able or willing to provide me with the substantiating documentation as verification to cure this violation, within the next 15 days, please have the information deleted from each of the CRA's you initially furnished it to, or I will have no recourse but to consider legal action as a resolution.

    Nelson v Chase Manhattan, 2002 provides a cause of action for individuals against furnishers of information.

    Hi Beth!
    Don't panic just yet. They do this all the time, it's not necessarily a case of real re-aging. To find out, just call the CRA that's reporting it (All of them if they are all reporting the new date) and ask them what they show as the Date of Last Activity or Date of First Delinquency as this is the date that the seven year point starts. This date should be from the original creditor, in your case Discover. Usually when a date is re-set like you are seeing, it has been placed by a new collection agency and their dates don't matter as long as they truthfully report the DOLA.
    So give them a quick call, and good luck! They should still fall off in October!
