Dismissal without cause..Report?

    I am helping a friend clear up credit. She has cleaned up her credit report up to 90%. Now something lurks out of the woodwork. She owed a 7000.00 to an insurance company while she was self employed. She was served with a summons. She had the money to pay so she did. She spoke with the lawyer today, who said since she paid before the court date, he would appear at and present a dismissal without prejudice.

    Since no judgment will be officially entered, will this public record be on her credit report?

    The attorney told her that she didn't have to appear for the dismissal.

    What do you think?

    I think she better show her butt up to make sure the attorney doesn't lie and get a default judgment.

    It happens, and has happened to people on this board.

    1*If this happens to her she gets to pay $14000 for a 7000 dollar debt.Ain't that sweet?
    Don't you just love Dee Faulty Judgments???

    IF their lawyer was going to dismiss the case, he could do so the same way that he got the case in the first place, fill out a form (or pleading) depending on the level of the court, asking that the case be dismissed.

    If your friend doesn't show up, the lawyer wins, your friend loses, and the lawyer doesn't have to show up to win.

    And your friend has to pay a second $7,000.00 for the privelege of being lied to by their lawyer.

    NEVER, EVER TAKE THEIR WORD FOR ANYTHING...

    IF you get a letter from the court saying that the case was dismissed, its still better to show up.

    Tell your friend to file a two line answer denying liabilty and send a copy of this to Court and the attorney - this will stop him getting any default judgment and save your friend from wasting their time going to court.

    If she files an answer and then doesn't appear at the hearing, I believe they can still get a default judgment.
