That's easy they put it on all 30 reports.Wouldn't want to take the chance on missing anyone you know! Besides it helps the creditors revenue cause there are now 30 more lowered scores to jack rates and fees on.
A lawsuit is only an allegation. An allegation is not a statement of fact. Therefore reporting a lawsuit is reporting information that is not factual and violates the FCRA.
The listing on my credit report says: 10/95 Suit, DEF. XXXX, Case No.XXXX, Plaintiff XXXXX,ver 08/01, Dismissed 11/95 Consumer disputes this item.
Update: No one contacted me on Monday with the info from the courthouse (of course). I called today and got the run around. They insist that it is a public record, verified by the court and it will remain. They are sending me a copy of the paperwork they got from the court. I sent an email to my attorney to ask if they can do this. Will let everyone know what he says.
If it can be done wrong they can do it?! They have a vast resource of ineptness and unlimited incompetence to pull it off!
They tell me it is correct because the court system verifies the info. I asked them to read to me the law that tells them they can do this. They told me to look in my FCRA "book" (????) at section 604 d. I looked this up online and it has nothing to do with this. I am hoping my attorney tells me tomorrow that they cannot do this. I will absolutely file against them.
Right, and tell them to be sure to report that lawsuit in your file, also. They don't seem to feel there is a reason to report lawsuits against them.
