My thanks to everyone that has assisted me on cleaning my credit. Have had much success with the help of this board. But still have a ways to go! My latest credit dilemma is recording of dismissed (vacated) judgments. I have disputed 2 judgments with all CRAs regarding judgments that were vacated, but were showing judgments. Experian investigated and now my EX report is showing the public record as "dismissed". Equifax deleted the listings completely. TU has not forwarded me the results of their investigation yet. My question is should Experian show this report as "dismissed" or should it be completely deleted from my profile as done with Equifax.
It should be deleted from your report. Did an attorney do this for you, or did you do it yourself (get the judgments vacated)? A vacated judgment is as if it never happened. It is not a "dismissal" - it has been undone. It never occurred in the eyes of the law.
I paid the account in full prior to the court date. The opposing attorney gave me a copy of the motion to vacate (of which I can not find) and also sent a letter to the court indicating that the case should be vacated.
What you need is the final court order to vacate. Did you ever get a copy of that? If not, get one from the court.
This happened in 1996 and quite frankly I can't remember if the court ever sent me a copy of the final order. Tomorrow I plan to contact the court to obtain information on what exactly this particular file contains.
