I posted on my cap 1 card being stolen in Dec. 2000. Shows charged off Aug 02. Should I try to dispute it now with CRA's, and if so, what reason do I use? Patti
Have you disputed it at all yet? Hubby had a c/o deleted, but it took a while. We did something a little different, though... oc/ca (fdcpa applies to both in TX) violated fdcpa. Sent them a strongly worded complaint letter via reg mail and crrr. cc'd the ftc and occc and some other folks with a copy of the complaint. Sent via crrr mail to the cra's copies of what was sent to oc/ca, the ftc and everybody else and asked them to register complaint based on the content of this info. They were deleted very quickly from 1 cra and took about a month with the other. Exp, of course, still verifies, but fooey on them. I hear now may be a good time to dispute because of their company woes and others have had good fortune with deletion. I would be careful, though...dont want to end up getting sued. Cap 1 does change their activity dates all the time. They also add money to charge offs and continue to accrue interest on a debt that supposedly has been written off.
no, I've been afraid to. Butch suggested in another post to send Mr. Cooke a letter, but I can't figure out how to word it. The acct should have been closed in Dec 00, since the card was stolen. I never checked my reports until October of last year, when I got started on my credit cleanup.
Can you tell if there were any charges to this account after you reported it stolen? Did they re-issue your card with a diff number? And, is the c/o under the old acct #?
Butch has a good idea to contact mr cooke about this. Just stand your ground and if need be, ask for signed bank draft slips. Now, was there a balance prior to reporting it stolen that was paid in full?
no, the account number is the same. And according to my CR's the balance was listed at $743 and now in the $1700 range.
Have you paid the valid charges (prior to reporting it stolen?) Just want to get some info so ya dont shoot yourself in the foot...strategy planning, lol.
no new CC was issued. The account was not behind. I'm wondering why it was not shown closed in Dec. There is no notation about the credit card being stolen.
right, but shouldn't it have some kind of notation about being stolen? I reported it, and called them daily for a couple of weeks to see if it had attempted to be used.
It should have been noted, yes. They also should have issued another card to replace that one with a diff number...unless you didnt want it. Now, you CAN dispute it as "reported stolen". Since the c/o date is so recent and the date of you reporting it stolen was so long ago, someone may say...hmmm...wonder why this is charged off when it shoulda been reported. Looks kinda like the charge off was due to activity that resulted from the theft. May work better to dispute this one via a letter instead of online, so you can explain simply explain this card was reported stolen on XX/XX. Now, if it comes back verified, THEN call mr cooke. Also, if crap1 isnt sending you statements showing the monthly interest they are adding to the charge off, then that is some kinda violation in the truth in lending act and I believe something else too...
