Dispute letters to the BIG 3 and v

    BIG 3
    How technical should I be in the letter. Should I just nicely state what I want done or should I state the laws the support what I am asking be done. Ex.

    To Whom It Concerns:

    I formally request that the following inaccurate items be immediately investigated. They must be removed in order to show my true credit history, as these items should not be on my report. By the provisions of 15 USC section 1681i of the Fair Credit Reporting Act of 1970, I demand that these items be reverified and deleted from my record.

    Since 30 days from the receipt of this letter is your allotted time under the law to reverify these entries, it should be understood that failure to do so within that 30 day period constitutes reason to promptly delete the information from my file (FCRA 15 USC s1681i (5)(A)).

    Also, pursuant to 15 USC s1681i (6)(A) of the Fair Credit Reporting Act, please notify me when the items have been deleted. You may send an updated copy of my credit report to the below address. According to the provisions of 15 USC section 1681j, there should be no charge for this notification. Also, please send me names, addresses, and phone numbers of individuals you contacted so I may follow up.

    Is this too much or too technical.

    Second question is should I lay it on this way with the CA with a validation letter or should it be a nice letter as well. I am getting ready to write letters and I am not sure if I should be as technical or write them with more of a personal touch.

    Tell yourself "I am an educated consumer, but they don't need to know this from the first letter". LOL

    For what my humble opinion might be worth, I concur with jlynn. Its been my experience with both the CA's and the CRA's that if you let them know right off that you know a thing or two, they tend to get defensive and billigerant (sp), which does not work in your favor. Save your FCRA and FDCPA knowledge for the second round of letters. It is possible that a "nice" initial letter can get the job done.

By the way, I've raised my scores from 0 with all three CR's to around 640 since June of 03, thanks to the info I found here and on another board.
