I recently disputed a collection with a ca. They labeled the account "dispute-resolution pending". I've posted on these people before. What should I do at this point? I have sent the valdiation 2x. (they didn't sign for the 1st time and sent it again) I am waiting until the end of next week to send the estoppel. They have notated the account like required with FDCPA. They following the law as far as that is concerned. They have not contacted me, so how are they to resolve this dispute? Do I have any recourse?
OK, let's see if I understand. You have sent a validation letter to the collection agency and the first time they did not accept it. So you sent it again, and they accepted it and updated the account with the Credit Reporting Agencies as DISPUTED. Basically I'd say you need to wait out the 30 days while they "investigate" whether you owe them the money and see if they send anything back, and if they do send something back whether it meets the qualifications for having verified the debt. However, I'm not sure I entirely understand where you are in the process, so if you'd provide a bit more information (about how long it's been since they received the letter and such), I might be able to help a bit more. -- cnswift
They keep verifying I guess with the CRAs. They are not in violation if they notate the account "dispute-resolution pending". I don't think they plan to resolve this. They have not contacted me. They bought this collection from Gulf States. I doubt they have anything with my signature. They are not licensed to do business in my state. I mentioned this in my validation letter. I am gathering info. for the Estoppel letter. If they don't delete the account I am going to file a complaint with the FTC, State AG, State Banking & Finance office and the BBB. I'm wondering has this happened to anyone else or they just trying to pretend that they are following the law and are a legitamate collection agency?
Keep copies of all the letters you send, and all the little green cards, and anything the CA sends back to you. If they've noted the account "dispute-resolution pending" then they're doing something. Wait for the end of the 30 day period, see if they send you anything back. The goal of validation is not to get them to prove the debt to the CRA, it's to get them to send proof to you personally. If they aren't doing that, they aren't fulfilling their legal obligation. Sounds like your on your way to an estoppel letter to me. -- cnswift
