Hi guys I noticed that I have a Consumer Dispute on my CR that has been there for SEVERAL months. Oct, nov, april, and July. I contacted them about this after getting an updated report today!!! . They Rep told me....it was b/c the company was disputed the trade line. My question is.. don't they have to delete the item if they don't verify it in 30-days???? If not... is not a violation of the FCRA .?? And.... is what the lady told me true? Can this item be in dispute for this long b/c a company has it placed that way?EVEN though it says CONSUMER DISPUTE.!!!! She said she was going to put the item in dispute again and wait to have THE COMPANY remove or correct the tradeline in dispute This doesn't sound right to me.!!!! IS she lying about all of this??? if so ....What should I do???
You should have had that mess all put to bed in 120 days or less. Usually much less. I simply refuse to piddle with them that long. You should have put them on a tight time schedule and kept them on it. Not the credit bureau, the creditor or collection agency. make them toe the line you drew in the sand, not the other way around. Usually blows their mind when they realize they are the ones that got shoved. Never play the other man's game if you can help it. You lose and they win if you do. So you make them play your game. Blows their minds every time. Anything over maybe 120 days for any one given account is plenty of time to resolve it in your favor unless you have to get an attorney. Then, who knows how long it's going to take.
Yikes! Now how in the heck do I get out of this one? Disengage mouth, pull foot out of mouth, engage brain??? Burp. Hiccup! Honesh ta Gawd, I was in my holiday cups. There! That oughta do it. OOPS! Sorry about that. Guess I must have been out in the back yard watching the product of my new invention. A cross between an elephant and a rhino. And I got an elefino out of it. LOL
Yes.. Who do I go after about this? The CRA or the Original Creditor? I still didn't think that you could have a dispute on your CR for this length of time! Can some please correct me if I am wrong!
go after the original creditor iswhat I would do even though it seems somewhat obvious that the CRA is probably at fault in this case. I feel fairly sure that they are. So if they want to do stupid things, point that out to their customers if at all possible. There is another angle to this whole ballgame and one that isn't thought about much. The more that we can point out the stupidities of the CRAs to their customers, the less confidence their customers have in them. The less confidence their customers have in them because it starts to bring grief on their customers for having made the reports, the less likely they will be to use them. Yes, I know it's an uphill battle trying to do that because the customers have few other options or sources to get credit reports. But if the cost becomes too great then they may stop and put up a hue and cry against the bureaus given enough time and grief and maybe their customers will start to demand better reporting procedures. Economic pressure from their customer basis can be a whole lot more effective than all of the screams we can ever put up to the CRAs. It may be an uphill battle all the way, but we have to learn to use every tool and weapon at our disposal. It's a cinch they will pay a lot more attention to their customers than they will us.
Thanks Bill for your help ;-) I am going to get started on my letter in the morning! I let you guys know how everything goes!
No problem. I know that sometimes some of my answers seem a bit on the nutty side to some people. I'm sure the last one is no exception by a long shot. But most of these CRAs are just about as stubborn as an army mule and if you are going to make a stubborn army mule blow the bugle then you have to get ready to cham the bugle up the only place the mule knows how to blow air out of and then sit back and wait for the music to start. All you gotta do is stand off to one side and look out for the kickback. I hear them army mules can kick real hard. LOL
