like a dummy i put a statement on an account some 5 years ago.
something like 'they ripped me off blah blah, took them to court blah blah'
can I now dispute this account at all?

I assume 'not mine' would not work at this point.

You never lose your right to dispute. In fact, the fact that you went to court over this really means that you dispute it!

Is the statement still on there?

I also had a statement added to an account - not by choice but that is what the helpful rep did! It was an account that they say was reported as a collection account a year and a half before I even opened it!

It still says customer disputes. You can't really get anyone to use common sense at a CRA, can you?

I send a letter to Experian threating to sue. Under the FCRA they must employ "reasonable procedures" to ensure "maximum accuracy"...

I told them that I considered reading and thinking "reasonable procedures"!!!!! In addition, the FCRA states that the must delete inaccurate OR unverifiable.....

Notice the "OR"... When you combine reading a tradeline and ascertaining that it cannot possibly be accurate, the CRA is obligated to delete. It does NOT state that the OC or CA must determine that it is inaccurate.

Essentially what I have observed is that they will only delete if OC or CA (1) do not respond or (2) state to delete it. However, this begs their responsibility.

I sent the letter to Experian CRRR. Let's see what they do now!
