Dispute/ Vaidation Questions

    I pulled my 3 reports via PrivacyGuard and noticed a few things that raised some questions.
    1. Only one of the three CRAs reported a collection item (which I have disputed and sent a validation letter to the company) as in dispute. Aren't they supposed to indicate the item as "in dispute" for those who pull my report?
    2. If the company doesn't respond to my validation letter and I get the CRAs to remove the collection tradeline, what can I do if the company re-reports the collection item to the CRAs?
    3. If the CRAs don't respond to my dispute requests in 30 days, what's my recourse?

    I have the same questions... I just sent a validation letter to a collection company and now I am wondering what is my next step?

    In addition, I know they have received it because the guy who calls me regularly called to say that he received it and that he "didn't have an address to mail it to". That's crap! It was on my letterhead. So, I called him, when no one was at the office, because I have no desire to speak to him, and left a message reminding him that my address was on my letterhead and that I would appreciate all correpondence be done via mail and to please not call me anymore. So, what does he do? He calls the minute they open the next morning, and then again the next day. What is the best choice for me regarding the discontinuation of these phone calls. There is no reason for me to speak with him... especially until I have some sort of proof I actually owe them the money.

    Any suggestions! Thanks.

    If he has a reason to speak to me, he should relay that in his voice mail to me. He now is calling to let me know that he has returned my validation letter and asking if I've received it. When I receive it, I'll call him, but at a time when he is not there. But, I'm curious to see what it says since he supposedly turned it around the next day, but wouldn't give me any indication that they had ANY proof of debt prior to that.

    Again, I've asked that all correspondence be done via mail... #1 - what do I do if he continues to call? #2 - if he does not have the information that I am requesting, what is my next course of action?

    If the 'proof' is a printout from their computer, or you can't tell if its from the OC themself, you print out a letter stating that their validation doesn't appear to comply with the FTC's Wollman Opinion.

    If there are other problems with their 'proof' you redispute it, until they resolve all of the problems.

    Did you write in the letter to cease any and all calls, and to have all correspondences in writing, a partial cease and desist still leaving them able to contact you in writing, is better than a complete cease and desist request.

    Since they got a reply ready in one day, chances are that it doesn't comply with Wollman.

    How many times would you suggest redisputing it and for how long do you let this go on?

    A few questions have been asked that it will help us help you.

    We really need to formulate a strategy as we go along. There are just too many variables to try to answer a queston like you're asking.

    The CA could reply in so many different ways we'd have to write an entire series of books to answer all the possibilities before they happen.

    So, as soon as you get your response let us know and we'll go from there.

    Well, I got a response back. They actually had a copy of the contract I signed back in 1996. I'm not sure if the company is still in business, though. There are a couple of things in the contract that could possibly help me to pay them less. I just need to figure out the best way to go about it. All correspondence should be in writing though, right?

    Funny thing, this apparently went into collections in 1997, but didn't manage to show on my credit until early this year. Does anyone know if it will fall off this year or does it still have the 7 years until then?

    Okay, they sent you the contract. Did they send you the itemized list of charges and payments? It should tell when your last payment was made on the account. That is the date of last activity and the 7 year time frame would have started at that time.

    Nope, no itemized list of payments or anything like that. How do I request it, formally, without having something I say come back and bite me later?

    2*Even it takes ten years; which it probably will.
    3*Probly wouldn't comply with anything even if it took them 2 weeks or longer.

    Don't request it. Tell them in your next letter that they didn't provide enough exceptable information. Or simply restate what you are asking for... original signed contract, itemized bill including payments and all added fees.
