I filed Chap 13 in 2009 and immediately dismissed it before the first payment was due. It has plagued my credit report since. I read on this board that I should dispute it as not mine since all of the information reporting was not accurate. I did this and a week later equifax removed it! I am thrilled but now I'm wondering...will it come back? Does the bankruptcy court send in reports every month? Since it's off now does that mean it will stay off?
I hate to say it, but it could return. Bankruptcies are public record, so it could very well show up again at some point. Let's hope it doesn't...fingers crossed.
If the credit bureaus were to ever start reporting the bankruptcy again they are legally required to give you five days notice. If they don't you can't use that to have them remove it again.
