Disputed CR and it was updated

    Judgment Creditor: First Financial Investment Fund II, LLC
    Creditors Attorney: Shermeta, Adams & Von Allmen, P.C.

    I disputed my credit report because the balance was wrong for First Financial. Before i disputed this is what it said:

    • Collection account. $2,831 past due as of Jan 2013/
    • Recent Balance: $3,612 as of 01/2013


    After I disputed it it came back updated to this:

    • Collection account. $3,032 past due as of Apr 2013.
    • Recent Balance: $3,612 as of Apr 2013

    Now the balance I got on a writ for garnishment(income tax refund) on 08/22/2012 was $2,940.57. They never get anything because I always owe on my taxes.

    Any help is greatly appreciated.

    Is this a violation of the FCRA?

    Should I call a lawyer or use this as leverage for them to settle?

    If the dispute was SPECIFIC, yes. ($100-$1,000)

    If they are a CA, it's also a violation of the FDCPA. ($1,000)

    I would try to keep disputing it, be prepared for the CRA to respond that it has been previously investigated, YOUR argument for that, when that happens, would be that "the account that I previously disputed was reporting an incorrect balance of $2,831 past due as of January 2013, the account that I was trying to dispute was reporting an incorrect balance of $3,032 as of April 2013, obviously you could not have previously verified information in a dispute received in March, that hadn't been reported until April. Therefore you did not previously verify THIS disputed information."

    That would add another $100-$1,000 for the FCRA violations under a second count. (FDCPA is one amount no matter how many counts.)

    You also want to keep disputing as well, you want to delay providing them with the writ of garnishment as long as possible, because that would give the CRA the easy out of updating the balance without a dispute going to the DF/CA. Just think, every dispute I send is worth at least $100, and you want to keep hitting the print button on the cash printing machine.

    First thanks for the reply!

    When you say "If the dispute was SPECIFIC" what do you mean? Do I need to send the dispute saying exactly what was wrong or just that the credit item by First Financial is wrong and not exactly what in it is wrong?
