Disputed items sold off !

    I asked for validation from the CA's and not to call by phone. The calls stopped fo a little while. Yet none of the CA's provided validation short of a few pages of copies of bills. Within a couple of months the simply sold it off to another CA and the calls and letter have started again with a vengence.

    I'm getting ready for another round of letters. Which letter should I use for the present CA and should I also write the one's who sold it off?

    How can it ever end if they keep selling off diputed accouts?

    Never read the fine print. There ain't no way you're going to like it.

    2*Not unless you have them on violations
    3*When they get tired of paying you $1000 per violation.

    Look in the sample letters forum for a sample letter "Subsequent CA Strategy"... There is a thread which which you can search for (by searching for the same name) which explains a little bit about the how and why it works the way it does...

    The goal is to get the current CA to stop collecting, and sell it back to the CA who dumped it on them. If they get the idea that you'll keep getting their buyers to sell it back to them, they'll either validate, or sell it back to the company that they bought it from.

    Is the account within the SOL for being sued?

    When deciding how agressive you want to be with this account, may want to take into account how likely they are to try to sue you, if they believe that they have enough information to win.

    You have a few choices, play cat and mouse with the current CA, wait for them to sell it to the next CA, and keep the dance on until it is beyond the SOL, then send a time-barred C&D.

    Or go the subsequent CA strategy now, and hope that someone down the chain doesn't decide to roll their dice with trying to sue.

    Chances are if they can't provide the validation and keep selling it, the validation won't ever be able to be provided, but there is always a chance that someone, somewhere has it, or can get it.
