A little history.....I filed BK-7 in Dec. 2002, and had that dismissed. Refiled BK-7 in Aug. 2003 and received discharge in October 15, 2003. Pulled my Equifax report on 11/1/03 and I disputed 6 entries as "not mine." 2 were the BK-7 filings, 2 were First USA credit cards, and 2 were accounts at a credit union.

The credit union accounts were not verified, and they were deleted. The First USA accounts both report as "charged off," and not "included in BK." These both came back as verified, but now have the notation of "consumer disputes information." On the 2 BK-7 filings, one was verified, and one was DELETED!(yeah for me) Here's the issue: The filing I made in Dec. 2002 was verified, and that case was dismissed. The filing I had in Aug. 2003 was discharged, and that is the one that was deleted. Like it didn't happen. Now, if I want to dispute the "charge off" on the FUSA accounts, how should I do that without admitting that those debts were included in the discharged bankruptcy?

I've thought of sending a letter to FUSA that they are reporting incorrectly, and they should report the account as "included in bankruptcy." If I do that, does that verify my BK-7 filing that was deleted and can EQ reinsert that into my report?

i would just say "i did not have a charge-off on this aco**** with XYZ Bank" (someone else stated this in another thread - dont remember who) because technically you didn't as it was included in BK.

I have already planned for that to be my next step. If that does not get it removed, that's where I have the issue. Is it better to leave it as a paid charge off with a zero balance, or should I request it to say "included in bankruptcy?" If I do the latter, I admit to the bankruptcy that I just got deleted from my CR. However, the CR still shows my first BK 7 filing that was dismissed.

Basically, leave it as paid charge off, or ask them to report it as included in bankruptcy? Which is better for my score?

don't worry about the next step until this one is completed - if it comes back the same way, then we will help you figure it out.
