Looking for advice on a particular situation. I filed BK-7 in Dec. 2002. That was dismissed in May 2003. I filed BK-7 in Aug. 2003, and that was discharged in Oct. 2003.

In Nov. 2003 I pulled my Equifax report and score, and I disputed both BK filings. The Dec. 2002 filing came back verified, but the August 2003 filing was deleted from my report. That was a good thing!

I again disputed the Dec. 2002 filing as "not mine." That has now come back as verified, but showing that it was discharged. I guess they are thinking that "how can this guy have IIB account on his report with a dismissed BK?"

I have disputed it again as "not mine." If it comes back verified, should I send EQ my dismissal papers? My thinking is that if they report it correctly as dismissed, I am then going to send the letter that asks for removal of a dismissed BK filing. Some of you may have seen this letter here or on creditboards.com. If I can get the BK filing removed completely from my report, it may be easier to remove the accounts that show IIB.

ANy suggestions? I feel that EQ will verify again. That is incorrect. Should I write them and explicitly say "case #xxxxxxx is not a discharged case. That case was dismissed."

    Thanks

I think from reading on this board that you would never want to send them copies of your BK regardless of Dismissed or Discharged UNLESS you want it on there for the full time period cause when you send it to them you just gave them the proof that you did file it.

I have seen this letter in fact am using it have it sent off to TU and EX right now hope it works in getting dismissed BK 13's off my report!!!!!!!!!!!!! In fact if it does work gonna shoot it off to EQ......can't right now cause I just disputed the Two as 1 not mine and 2 the 96 one is beyond the 7 years.
