disputing Portfolio Recovery TL

    hey all,

    i have a queston about how to handle a portfolio recovery TL that is still within the SOL. i have never recieved any sort of mail from them, but the account is from an old MBNA card . the balance is about $1500 the DOL was 4/2000. i live in the state of illinois and i am hesitant to make PR validate as i am still in the SOL until 4/2005. what do you think i should do?

    -WHAT is the "original date of delinquency" (ie charge off date)?

    -IF you are concerned about being sued (inside the statute of limitations) DO a search on the net, or your local court house, to see if PORTFOLIO RECOVERY has EVER sued anyone etc etc.

    -In most states a debt collector cannot sue unless they OWN the debt :)

    -Because there has not been "initial communication" with them, if you send a request for "validation", requesting documentation to show "identity and amount" of the debt FROM the original creditor, they cannot continue to collect until they provide it. FDCPA 809 (b)

    the DOLA was 4/2000. i live in the stae of IL which has a SOL of 5 years.
    how to do i find out if portfolio recovery purchased the account or if they are just collecting?

    I think if the MBNA TL says it was charged off, Portfolio Recovery probably bought it.
