Disputing with Experian

    Hello! I have filed several disputes with all CRA's and everything has come off EQ and TU. Experian validates everything! Does anyone have any tricks when dealing w/ EX? Gracias!

    I have had greater success with written disputes than online with EX. Currently, because I sent an intent to sue, I am in their "special handling" office. I have one person assigned to my file.

    Today I spoke with her. Pointed out that there was an inq that was 2 yrs 2 days old still being reported, she put that in dispute. I also disputed extraneous versions of my name and about 8 addresses. They are all currently blue.

    Although I have had greater success one-on-one, I still cannot get them to delete tax lien.

    Experian claims that they use the date of release to start the 7 year clock. When the original release was mailed to me (I had to be the one to file it with the court because the state wouldn't), it was sent to my previous married name to the address I had in 1993. Of course, this was non-forwardable and it was lost.

    When I saw that the lien was being verified, I contacted the court to find that a release was never filed (didn't know it was my responsiblity). I contacted the state and they sent me a new release dated 6/2002. Experian said that they will delete 6/2009. They claim that they can't use the letter form the state dept of revenue stating that the date of payment was 5/15/95, because it doesn't come from the court. I quoted other cases where the CRA lost when they did not use ALL available documentation regardless of who provided it. It didn't matter to them.

    Initially, both TU and EQ has the same position. The minute I sent case law, quotes of the FCRA, and the letter from the state, they deleted. EX is simply refusing.

    I am in special handling because of this. I have sent them an intent to sue. I have them on at least 7 violations. They put me in the special handling so that my file gets more directed attention to prevent the lawsuit. The problem is, that by continuously refusing to delete the lien combined with the fact that I have been in special handling, they unwittingly gave new meaning to the term "willful non-compliance"!!!!!

    Isn't is amazing how morons will spend so many man hours trying to fight you on this? It would be more cost effective for them to just remove the item. Certainly they know by looking at the original doc's that you sent, what the real release date is.

    I wonder if the higher ups knew what these people were doing and their poor decision process, what they would think about it. Just a thought.

    I wonder who the CEO of Experian is?

    I think I will see what happens when I move up their food chain! LOL

    To me it is ludicrous! The wording is literally, "7 years from date of PAYMENT" !!! I even told them in my intent to sue letter that a judge would see the letter from the OC (the state) and the date of payment and give a slam dunk on that violation and tack on a little 'willful non-compliance' while he was at it!

    Didn't matter though!

    We'll see.
