    I'm starting to feel like I'm at their mercy! SMH! There has to be something they are doing illegally lol. It just doesn't seem right. I have a few attorney friends I might be speaking with to explore my options. The CA has until the week of the 21st to respond. I'm guessing they don't know I'm not afraid to sue. They need to check my credentials lol. I was already a party in a class action suit against Arrow Financial (and we won)...

    Sometimes a letter from an attorney is all it takes :)

    Has till the 21st to respond to a PFD?

    Ok...I got to my report and this is the information they are reporting:
    Date opened 12/2012 (nothing reported - got a letter with basic info then but of course, no validation)
    Reported since, last reported, date of status: all 8/2013
    Status: Collection - past due as of 8/2013
    Status Details: Scheduled to continue reporting until Jan 2014

    We'll see Mindcrime. I didn't tell them they had until 10/21 to respond but that's all I'm giving them until I get my attorney friends to write a nice little letter. Unfortunately, the lead attorney from the Arrow case passed away from cancer several years ago - or else I'd call him. He was ALWAYS up for a consumer protection fight! :)

    Update: So, my attorney and I called them (after they said they didn't have the account anymore) and they said yes, they have it, they did not buy it - they were assigned in Dec. He said they do not purchase debt. Since I have no proof of this entry before, I am stuck on this one. They gave the spill about they would take my offer but that they couldn't delete it because (wait for it) it's a utility! WTW? And you can't delete utilities. Now I have never heard this one!

    I find it hard to believe that anyone would assign something to a CA 8 months before it's due to fall off and never assigned it before. Anyhow, my question now is, what other recourse do I have? I'm not giving them anything if it's due to fall of in Jan. I did finally breakdown and tell my loan officer who told me I should be fine but NOT to dispute it with the CRA which I did not.

    At this point I am trying to be proactive and see if I have another avenue to get rid of these folks. I think I still qualify for the loan with my scores but I'll find that out for sure next week when she pulls it again.

    Is the person who assigned them, the original creditor, or a JDB who purchased the account? :)

    A JDB purchasing and assigning them the account would make the time-frame of assignment more plausible.

    Did they put the "we don't have the account" in writing? If so, I would dispute the trade line, as being invalid based on their claim to not have the account.

    Yes, the OC assigned it because I called them last week and they told me Diversified had it. And no, they didn't put that in writing. They said it to my attorney and can always say the CSR didn't know what she was talking about.

    BTW, what's a JDB?

    JDB=Junk Debt Buyer=A business that buys $1,000,000 worth of zombie debt for about $3.

    There's always calling back with a recorder running. But depending on your state laws, you may have to inform them you're doing it unless when you call them they have one of those "this call may be recorded for quality purposes" disclaimer.

    Hey folks. I just wanted to report back on this issue with Diversified. So, I finally broke down and told my loan officer what was going on. Her response was not to worry about it but not to dispute it. Long story short, after that conversation, she never mentioned it again, I closed on the house without a hike in interest and didn't have to even pay it to close. Oh, and it had once again fallen off my Equifax report - they are so full of it! Lucky for me, it's supposed to fall off this month anyhow so rather than dispute it, I'll just wait.

    Thanks everyone for the help on this...it was really giving me many sleepless nights...all for nothing.
