A noticed a few weeks ago a hard enquiry by an organization named CBA. I have no account with anyone by this name, have made no recent credit applications ,and have no delinquent accounts that could have been referred to a collection agency. I disputed the inquiry with Experian and received their standard crap along the lines that they don't have to investigate inquiries. There is no address, or other information listed for CBA on the report and I therefore wrote back to Experian requesting the address/telephone number for CBA. Their response was to tell me that I needed to take this up with CBA directly (having been informed that I have not got their address...) and to list the action they have taken "on the next page" which is blank! Surely there must be a violation in here somehere - I think a trip to the small claim court is well in order - any suggestions? Thanks in anticipation. Neil
A no permissable purpose claim is against the company pulling your report - not the CRA. Call EX and get CBA's address and start there.
I understand that - however having requested the details from Experian twice and been refused I am wondering what kind of non-compliance I can nail them for. Neil
this is a violation under the FCRA they failed to comply with procedural requests which seems to be par for the course with experian. did you send exp a written request fro procedures by CMRRR if not do that again now and put that tracking # on your letter. state that you want them to explain how they maintained their procedures and what method they used to verify that info. mention that unless they provide you with this info within 15 days according to law including the address of the company that pulled your report you will sue them. heres the link to the FCRA which states the proper codes to follow, good luck http://www.ftc.gov/os/statutes/fcra.htm#607
Thanks for the advice Fun4u2- the second letter was sent certified and I have the card back - their time is up and so is my patience. They are a horrible outfit and are definitely going to get a summons when I have time in the next few days to file this.
