I just received a mail from some company named Collection $olutions Does this violate this FDCPA law § 808. Unfair practices [15 USC 1692f] (8) Using any language or symbol, other than the debt collector's address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business. Sounds like it to me. I want your opinions though. Should I sue ?
I'd say thats a violation then. The name makes it obvious they are a collection agency. If I were in this situation, I would write a letter to the CA informing them of their violation. Tell them your neighbors were picking up your mail for you while you were out of town, and now the whole neighborhood knows you are in debt! Demand that they delete the account or you will take legal action against them for violating the FDCPA, as well as your privacy. Also tell them you are filing complaints with the BBB, FTC, and AG's of your state & their state. Make sure you don't lose that envelope!
Sure. It's simple. Just send them a self addressed stamped envelope and tell them to send the $1000. Tell them you are entitled to it.
