I just can't seem to get this last collection agency off of my Transunion credit report. The CA is First Credit Solutions, and everytime I dispute the account, it is verified as accurate. I have been in the validation process with FCS since February 12, 2002, and they keep sending me letters saying they have ceased collection efforts and they are waiting for Discover (the OC) to provide the validation I requested. They say "this could be as much as 90 days" to complete. They have provided me with a computer printout of my name, account number, amount, etc, which proves squat, and they have also provided copies of the bill of sale of the account and an assignment notice (none of which refers to my account and does not contain my signature). They have yet to provide a signature card or statement of account. I send these clowns a letter almost every day and still have had no luck. The BBB has done nothing, the FTC and Attorney General haven't done anything either. I provided TU with all of my letters, along with other documentary evidence, and they still verified it. I just received the report today..."verified, no change". That's it. Do I have any grounds to sue TU for FCRA violations? If so, I think I am going to move on it. Any thoughts...I need help with this one.
I think you do. If the Creditor or CA tells you via written word, "they have ceased collection activity on the account", you should assume TU is liable/lying when they say they have verified the account. Then it would be TU's turn to deal with the creditor who they claim "verified" the information. You definitely have grounds to bring this in front of a judge. -Peace, Dave
I had trouble with them as well.. I filed a police report, sent a copy of that as well and they finally sent me a letter requesting deletion. However, 1 CRA of course has it on.. I am attacking that CRA next.
