Hello, There is a company that I paid off. I have credit report with amount they said we owed. I have the canceled check for that amount with paid in full on it. They keep calling and have said verbally that there are now other fees. Every time we talked to them they would say something differant. My husband just said sorry you have been paid in full and then we stopped answering the letters. He had asked them to send us something and they will not. I then sent them a letter (certified mail) stating not to call us again that they have been paid in full and any communication to us from them must be in writing from that point on. That was 6 weeks ago and they continue to call at least once a week. Are they allowed to do this and is there anything I can do to stop it?? I live in Michigan if that makes a differance. Thanks,
Are you dealing with the original creditor, or with a CA? Did your husband make his request in writing?
We are dealing with the original creditor. We sent them a letter in the mail return reciept required (so we have proof they got it andit was signed for) and this is what it said: Your Company has been paid in full. It is inconvenient for you to contact me by telephone at any place or at any time. You are prohibited from contacting me by telephone under any circumstances; however, you may correspond with me through the mail. We have not spoken to them by phone in a long time and deffinately not since sending that letter which was 6 weeks ago. They continue to call once a week. They leave a message for us to call them. They have sent NOTHING by mail to us since we paid the amount owed. They had said to my husband that we owed more and he told them to send it to us in writing. That is when I sent them the letter telling them not to contact us my phone. any other ideas?? Thanks
I just read on a site somewhere that if you request a written amount for what you owe, they have to send something within 30 days. Also read that you should send certified letter to request they not call you anymore, which you did. You did everything right from what I read. Maybe call them back and tell them "you know your rights and by law they must send the amount they think you owe by letter and they must not call and harass you anymore" or you will seek an attorney. That might shut them up.

Yes they are still reporting the charged off amount as still owed (which I sent the paid in full check to them about 8 months ago for the full amount of the charge off) Thanks for any help.

Did they release the lien on the car title? No because they said we now owe more money than is even on the charge off. When we purchased our new home we showed them the canceled check for the amount that the lender was reporting as charged off and they copied it and laughed and said it was good enough as far as they were concerned. They will not remove it because they said we now owe more and they will not release the title. That is when we asked them to send any further correspondence in writing. I sent the letter telling them not to call thinking then they may send something in the mail but they have not sent anything in the mail to us in over 6 months. Do I have any legal action for them continuing to call us? Is there anything else I should do or know? We have kept track of every call they make to us and it is generally only once a week but still we wont talk to them and want them to stop!!
There may, or may not, be any additional amount due. Since they have not released the lien, if they believe an amount is due, they might try to repo the car, so you might want to force them to respond in writing to get this resolved. You have at risk not only the amount they claim is due, but your car. You could force the issue into court, to force an accounting of what is due, if anything, over at least 3 issues: 1) Erroneous reporting on your credit reports. If the TL has not been updated to reflect your final payment, it is erroneous. Have you disputed thru the CRA? If so, and if they verified the amount that doesn't include your payment, then they are reporting in error, whether or not they have added additional charges to what they are reporting. 2) Failure to release the lien on the paid off loan. If it is, in fact, paid off, they have this legal obligation. It would then be your car, free and clear. Since they filed their lien thru your Deparment of Motor Vehicles, have you talked to them? Explain that you paid what your records say is due, that the lender claims an additional amount is due, and won't release the lien, but they will not give you any information in writing of how they come up with that amount due. You might also talk to your local DA, since failing to release the lien if it is paid probably violates something. Third, you might talk to an attorney who deals with consumer law.
