Doc,LKH,Lizardking,Ender,George,etc

    Here is one of my few dilemmas, hopefully you all can assist me :)

    I am scratching my head and wondering what should be my next step with my neverending saga with this Dr office. I hope I won't confuse you in trying to explain. Here it goes:

    -01/01-CR from mortgage lender (3-in1 ?)
    Balance: $287.00 Status: 0-5

    -02/02-CR from EQ (pulled online)
    Balance: $0 Type Acct/Status: Open/120+
    days pst due
    *Also states PAID COLLECTION

    Please note I disputed this because it said Open/120+ days past due. Therefore, my dispute was account closed. Everything else looked okay. Now is where I think I screwed up!!


    -03/02-CR from EQ (resp from disputes)
    This creditor has verified to EQ that this acct has
    not been closed...blah,blah,blah.

    (Here is the new updated version)
    Balance: $288.00 Status: 05
    *COLLECTION ACCOUNT-Prev Status: 12/00-05
    Prev payment hist: 1 time 90+days late

    Now, I was very mad and re-disputed. They totally screwed this up. I did pay this account off on 03/29/01 $287.92. I can't believe the creditor responded saying that I had not paid. Needless to say I disputed and here are my final results:

    -06/02-CR from EQ (resp from round 2 disputes)
    This account has been updated to report as a paid
    charge off (I just about threw-up when I saw this)

    Balance: $0 Status: 09
    *PAID CHARGE OFF-Prev Status: 05/00-05
    Prev payment hist: 1 time 90+days late

    Here is where you WONDERFUL PEOPLE with your great advice and opinions come into play. I do not understand how this can change from bad to worse when the whole time it was paid in full, not settled. Everything has been changed from balance, to previous status to charge off. Why would they say that now it's a charge off when the account has been paid for 15 months? I also thought an account had to be 120-150+ days late to charge off.??? Should I contact EQ and point out these 'errors' to them and re-dispute or should I just send Doc's nutcase letter to this Dr. This whole ordeal is driving me crazy but on the other hand I have accomplished a few things.

    Thank you for any help you may have to offer.

    An account can charge-off after 30 days if the creditor wants to. Banks must charge-off after 180 days but I don't think there is any law that specifies when a creditor can charge it off.

    Okay, thank you. However, if the account was listed as a collection account and it was paid 16 months ago how can they, as of 6/02, change the status to paid charge off? Does that make sense? My thinking is it should have said paid charge off back in 03/01 and not updated to that status in 06/02. Any thoughts? Just to let you all know I have found this website very helpful. Thanks to everyone who has shared their findings, opinions and advice to others and myself. Have a wonderful weekend!! :)

    My suggestion would be to write a scathing letter to the doctors office. Advise them that they have changed their reporting of this acct several times and it has been incorrect each time. Advise them that they are in violation of section 623 of the Fair Credit Reporting Act (Responsibilities of furnishers of info to cra's) bu reporting incorrect info. Suggest that if this continues, your atty has advised you to file complaints with the BBB, FTC, your state medical board etc, etc, etc. You can then suggest that maybe it would be easier and save them a lot future problems if they would just delete the entire listing. It may work. And, if they don't correct it or remove it, file complaints with the above mentioned and anybody else you can think of.

    I agree with LKH. At the same time, I would also send a letter to the CRA and dispute it with them as well. In the same letter, I would ask for procedure request. They must provide this. Make sure you send everything CRRR and keep copies of the letter. this sets you up to have your paper work to file a lawsuit if this isn;'t resolved with the CRA as well..

    Once again thank you for all of your help/advice. I need to get some toner for my printer ASAP so that I can get to typing these letters. I also have to OC account that are paid chargeoffs that I want to send Doc's nutcase letter to. Thank you. :)
