I saw where you posted on bayhouse some info regarding TU and your lawsuit against them. I will be filing on them within the next 2 weeks. I don't want them and Experian to be scheduled at the same time. If I need some help or info can I email you? I would like (if I need it) you to fax that info you offered to Christine as well. I'll email you my fax number if it comes to that. I wonder why Lizardking had such great succes with them? or any of his lawsuits, in fact? I guess I'm scared..but what can it hurt? I know I have my papertrail and my "ducks in a row". They are the ones who have something to prove..not me.
Hi, Christi. I'm certainly happy to help any way I can. I think the reason some have had success with the small claims lawsuits against CRAs is simply because they're settling for negative tradeline deletions rather cash settlements. (I'm thinking specifically of myself, LKH, and Lizardking. Perhaps they would -- and should -- disagree with my oversimplification.) Basically the CRAs want to do whatever is easiest, financially and in every other way, and deleting tradelines costs them very little. Of course, perhaps we made good arguments as well. In Lizardking's case, he was strictly arguing that his was a case of straight identity theft. LKH and myself, on the other hand, were arguing that the CRAs violated the FCRA in various ways when they handled our disputes. Anyway, that's my quick and dirty summary. Oh I will continue to read religiously as I have done since March. I learn something every single day I read. The only reason I'm asking Experian for money is because I have them over and over. Everyday they kept changing the date the results were due to one day later. I printed it out each and everyday. Now, they have deleted 3 of the tradelines and updated one to paid in full, never later. But...they still violated my rights and I want money from them or deletion of the other negatives (5) and the remaining inquiries they somehow keep verifying. I filed last week so I should be hearing soon I think. I do have the Consumer Affairs contact and may fax my settlement offer to her this week.
