So I sued a CA for FDCPA, FCRA, and Texas Debt Collection law violations, in Texas Justice of the Peace Court (equivalent to small claims, except with pretty similar discovery and procedure rules to State District Courts). The CA responded with a settlement offer but refused to delete. I turned them down, and today I received a notice they'd removed the case to Federal Court. Anyone have any advice on whether I should... 1) File a motion to remand it back down to Texas JP Court (I understand this is unlikely to succeed, given two out of my three complaints in the suit were issues of FDCPA/FCRA vs. state laws)... 2) Go ahead and go through the federal court process? I've read some folks saying Federal Court is not as scary as it looks, and I could actually amend my complaint to ask for more money to compel the CA to settle. 3) Amend my initial complaint to drop the federal law issues and only raise Texas collection law issues? Any wisdom would be appreciated.
