DOLA and CA

    Hello,

    I have an old collection account that was charged off years ago the last payment was in 1997 and the original creditor removed the charge off from my credit report. I disputed the collection account and everyone but Equifax removed it. They go the the Date of Last Activity which for some strange reason is 1/98. I redisputed it but would like to know what else I can do to get this old dept removed. Should I contact the CA? Any suggestions would be greatly appreciated.

    If you mean call them;NO !

    I would send them the Validation letter.

    It looks like the debt was maybe illegally re aged.

    The Date of Last Activity (DOLA) is practically irrelevent.

    The consumer reporting agencies use this as a tactic to confuse the consumer.

    The statutes governing the reporting period, and I am assuming that's what you are intersted in, do not even mention DOLA.

    The only relevent dates are the DATES OF ORIGINAL DELINQUENCY. This is the start date of the 7-10 year reporting period for negative info on your credit report.

    I do agree that one or two of the major CRA's do list the first 30 day late in the "payment history", BUT unless the first 30 day late is within the last 2-3 years, it is not reliable info to use for an "obsolete" listing.

    The "Metro 2 Format" by which most CRA's use to process info about consumers, REQUIRES the "furnisher of information" to provide the ORIGINAL DATE OF DELINQUENCY."

    39. Question: Are there any special reporting requirements for a first time
    reporter when sending data to the consumer reporting agencies?
    Answer: It is very important to ensure that the FCRA Compliance/ Date of First
    Delinquency is reported accurately.

    18), the Date of First Delinquency must reflect the date of the first delinquency that
    led to the earliest delinquency reported in the Payment History Profile. In this
    situation, the Date of First Delinquency must be reported, regardless of the
    Account Status Code being reported."

    Seems to me if they report without including the "original date of delinquency", AND YOU DISPUTE IT WITH THE CRA, both the furnisher and the CRA could be liable for not conducting a reasonable investigation

    PS- I have the instruction manual for the Metro 2 if anyone needs it.

    And there is NO REASON not to call a collection agency. If you are SOOOO afraid to talk on the phone, THEY HAVE ALREADY WON!!!!

    1*The are many very good reasons why you don't get on the phone with A CA.
    2*Being afraid is not why you don't get on the phone with A CA.

    Better Read up on the board about this subject and learn what it's all before dispensing such incorrect advice about talking to CAs on the phone.

    1*if joining this month and posting only 5 times
    isn't new what would you classify as new?

    2*For one How do you build a paper trail with a telephone?

    How did you dispute it? If you dispute an account as "not mine" all they do is match the spelling of your name.

    MAIL- a dispute as follows.
    "Account ## so and so from scumbag collection agency is a fraudulent entry. It is an illegally re-aged account that was originally with (name of OC) in which the DOLA was XXXXX.

    The account is obsolete, please delete immediately."

    If they respond in ANY way other than deletion, file a complaint on line with the FTC against the CRA for their failure to delete an obsolete account after receiving verifiable information from you.

    Make a copy of the filed complaint and send it with a REDISPUTE to the CRA, stating you have filed this complaint and are prepared to take further action.

    Hi All,

    Thanks for the advice just a quick update I filed a complaint with the FTC about equifax and suddenly the RMA item is off my credit! Here is the link i used.

    I just clicked on file a complaint and filled in the relevant information. Thank you all for your help.
