double collections

    OK, I have something I can't find a post that is much the same.

    Before I was 18, I got a Sprint PCS account which I defaulted on. The account was bought (I believe) by Calvary Portfolio Services. It is now being collected by Redline Services.

    Calvary appeared on all three of my reports at one time, but Equifax was kind enough to remove them because the Sprint PCS account had been removed due to my being underage when it opened.

    Now Redline is appearing. It's getting to the point I am able to pay it, mainly because it is the only thing standing between me and the two years I've put into building credit. The problem is who do I contact to try a "pay and remove" strategy? Can Calvary guarantee their assignee can remove the tradeline from my credit report? Can the assignee guarantee that Calvary will remove it's tradelines from the other two bureaus?

    Any help would be appreciated.

    did you use the card after you turned 18? You cannot enter into a contract before the age of 18 and if you didn't use the card after turning 18 tell em to jump in the lake. And you don't have to pay it either.

    Well, it was my cell phone which I did use after 18. I'm not sure if cell phone contracts include a "if you use this you also agree to t/c" clause, but i presume they do.

    How far are you from being outside of the SOL?

    How much is the account (approx)?

    Fairly close to SOL (which is 4 years in GA i beleive)...its only $500...im not all to oworried about a settlement, just want to have access to my credit.

    Since just paying doesn't usually result in the trade line being deleted, the options are similar to:

    1) Dispute it the same way that you disputed the original creditor's account. The only caveat with this is if they are reporting the OPEN date as when they received the account, and not when the original account was opened.

    2) Wait out the SOL, and send a time-barred C&D to both CA's.

    This means he don't have to pay it and it must be removed from his reports..

    There is no SOL defense needed on and illegal contract for a debt that is not legally collectable.
