Draft Validation Letter for Review

    Okay, here's the letter

    To Whom It May Concern:

    In recently reviewing my credit profile, I discovered the above referenced account. This is not a refusal to pay, but a notice that your claim is being disputed. This is a request for validation made pursuant to the Fair Debt Collection Practices Act. Please complete and return the attached disclosure request form.

    Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some contractual obligation to pay you.

    You should also be aware that sending unsubstantiated demands for payment through the United States Mail System might constitute mail fraud under federal and state law. You may wish to consult with a competent legal advisor before your next communication with me.

    Please complete the Creditor Disclosure Statement and provide the following information return same to me within specified time period, infra.
    1. Please evidence your authorization under 15 USC 1692(e) and 15 USC 1692(f) in this alleged matter.
    2. What is your authorization of law for your collection of information?
    3. What is your authorization of law for your collection of this alleged debt?
    4. Please evidence your authorization to do business or operate in this state.

    Questions:
    I have seen people advise against signing letters to CA? In leu of the signature, what should I do? Leave it blank?
    Which Act requires CAs to respond within 30 days? I'd like to specifically indicate as much in the letter.
    Any other advise is greatly appreciated.

    Thank you to those who drafted the sample letters from which I created the above.

    Looks good!! Just type your name, don't sign it. There is no set 30 day law, it is just a good fair timeline to go by.

    Would you recommend that I get my old addresses removed before disputing?
    I'm applying for an apartment pretty soon and I'd hate for an open collections to get me rejected. So, I'm kinda eager to get the validation thing going.

    I noticed that you took your validation letter was similiar to mine (see original post) minus the following paragraphs.

    I was curious was you don't include any of the above. I thought it was good language. Do you include this in later correspondence? I\I'd like to get this out today; so, if you could advise, that would be great.

    1*&2* It appears you picked up this language from the estoppel letter and added it to the validation letter.
    This is a 2 step process.
    Step one Val, Letter.
    Step 2 Estoppel letter if they fail to validate in 30 days.
    By combining the 2 steps as one in your letter what do you do if the CA fails to validate after receiving your letter?

    I've came across this post. How many of these letters to each of your CA can you send? Can I go through my report and send 1 to each of the CA's on it?

    Hoe many CRAs are there?
    Who is each one collecting for?
    What is the amount of each debt?

    There are a total of 8 of them..

    2 of them are with RMA for $408 and $120
    American Collection - $30
    (Same company-- Different Locations)
    Credit Control - Paid (Returned Cable Boxes late)
    Credit Control - $253
    ABQ Collection SVC $195 (says paid)
    Paul Michael Marketing $85
    First USA - There is a collection Agency but unknown ($398)


    Should each of these get a letter for each account like the letter that you posted

    JB my wife had 9 different accounts listed from Physicans Credit Bureau I sent one letter listing all nine accounts with 9 Disclosure request forms asksing them to fill one out for each one.....don't know if I did anything wrong but thats the way I did it

    Send the letter to each CA for each Account.
    You can put more than one letter in an envelope if they are going to the same address.

    Because they {CA} can forge It onto other documents thus making you liable for them.
