Dumb question of the day..

    Hi
    I have made my payment to Sterling Bank n trust,
    I neglegted to get in writting they would delete after payment was recieved. What do I put as a reason to dispute the account with the CRA ? obsolete?
    incorrect balance ? Not mine (again) The CRA verified te account once in june before I agreed to pay Sterling so I don't want it marked frivilous..
    I don't want to wait for Sterling to get around to updating either....

    You should send a procedures request to the CRA to make them prove they actually verified the acct. The CRA has 15 days from receipt of your letter to provide their procedural process. If they don't respond in time then tell them to delete TL or face a lawsuit.

    Assuming Sterling agreed to delete and you still have a contact there, what about contacting them directly and asking if they have, in fact, received your payment and will they, in accordance with their agreement to delete, fax a UDF to the CRA requesting the deletion? (Also ask them to fax a copy of it to you so you can "have it for your records.")

    This would definitely be the fastest method overall.

    Obviously it's best to get this stuff in writing. If your agreement was verbal they STILL must abide by what they told you they would do, so hold them to it.

    I believe we are NOT as powerless as we thought in these cases.

    The law is designed to protect the LEAST SOPHISTICATED CONSUMER, Of which you are the least, (For settlement purposes YOU can play dumb as a box of rocks) :).

    "The Seventh Circuit evaluates communications from debt collectors "through the eyes of an unsophisticated consumer." Jang v. A.M. Miller & Assocs., 122 F.3d 480, 483-84 (7th Cir. 1997); see Avila v. Rubin, 84 F.3d 222, 226 (7th Cir. 1996). The unsophisticated consumer is a "hypothetical consumer whose reasonable perceptions will be used to determine if collection messages are deceptive or misleading." Gammon v. GC Serv. Ltd. Partnership, 27 F.3d 1254, 1257 (7th Cir. 1994). This presumes a level of sophistication meter," Avila 84 F.3d at 226, and "protects the consumer who is uninformed, naive, or trusting," Jang, 122 F.3d at 483-84 (quoting Gammon, 27 F.3d at 1257)."

    If you "TRUSTED" them you do have a leg to stand on.

    Follow Pooches advice and let's see if they will resolve.

    I do not understand why people are having a problem with sterling. as I stated in another thread, before I knew anything about 'credit repair', about 3 or 4 months ago, I got a mortgage loan, one of the stips. was I had to pay everything off, I called sterling for a settlement, they offered 50% no questions asked. I paid, they deleted the same day. I did not know at the time that things even could be deleted, much less did I ask them to. I have faith that if you call them they will delete, I am sure this was a mere oversight on their part.

    I agree with you I fully anticipate that happening..the account hasn't been updates with new info or balances just verified in June thats its mine. If I hadn't felt trustful when I spoke to mr Underwood,I surely would have gotten something in writing. I knew he had been the Point of contact others had dealt with here on CN. before. But since I didn't get the actual paper I just wanted an opinion on how to proceed.

    Well Since Underwood agreed to help you he just needs to be reminded. Not everyone to whom money is owed is an a$$hole.

    A little fact we tend to forget on here.

    Try your nice, sweet disposition and wag your eye lashes at him over the phone and I bet you'll get what ya need.

    could you post your results when you conclude. I too made that STUPID mistake. Not only on one but TWO paid charged off accounts. (I know, I know, DUMMY!)

    Butch, you say to call the OC but what about the 'paper trail'? I'm thinking of sending a letter (maybe Good Faith?) because I have receipts (Western Union) of payments that were made to settle these accounts. Any feedback of my thoughts?

    But since I just started this clean up quest in August I'm in need of all the input, guidance and constructive criticism that my superiors can offer.
