DV question

    before it sounds like im posting for every question, i am searching the forums, and finding alot of great info, but many times its conflicting information.

    so here goes...

    on my credit report, i have a bunch of collections.. however they are old, and a majority of them fall off in the next 6 months or so.. so im "not messin with em' "

    i do have 5 others that wont expire for 2-3 more years, but they are 4-5 years old (and small amounts, the biggest is under $300)

    I am contesting them to the CRA's, I have the letters all set for that...

    the question is should I, or can i, DV the CA's? (They cant sue, its past SOL)

    or should i wait for the CRA's decision, then try to make a deal?

    are you allowed to debt validate 5 years after the first 30 days?

    You can always ask, but they can argue that they don't have to provide validation.

    The only requirement in that case would be to report the account as being disputed.

    But that's *GREAT*... :)

    If you dispute the account after they've received the validation request/dispute, they're required to report the disputed status of the account, but 99% of the time, when they verify the account, they verify it without the dispute notation.

    So, you want to include in your CRA dispute, that the account is disputed, but not reporting as disputed pursuant to Section 807(8) of the FDCPA.

    Now, your CRA dispute is germane to the incorrect reporting of disputed status, thus actionable against the DF for reporting false credit information in response to a CRA dispute (FCRA), and reporting false credit information, including that the disputed debt is disputed (FDCPA).

    $1,000 FDCPA
    $1,000 / CRA - FCRA

    Up to $4,000 of Cha-Ching... :)

    Wouldn't it be better to have the game of "Let's Make A Deal", be to decide how much money they are going to pay you, and not the other way around? :)

    so a DV at anytime is considered a dispute (I assume word it that way).

    and that means i should probably do the DV before the CRAs?
