dv'd ca...oc sent verification

    okay....back in December of 2003 i dv'd a ca two times and never heard from them again. I received a packet today with statements from july 2003 through april of 2004. But here is the thing. this account was co on my cr with a DOLA showing as 3/2002. Also on the copies of the statements they do not show any activity or places that the card would have been used. All i have on the copies are the account number, payment due date, new balance and minimum amount due. Also on the statements are the cc emblem. Where the activity of the card is suppose to be...there is a message saying help is available and a customer service number and my home phone showing as a "correct record". This cc is within SOL....but how can it show activity in 2003 if charged off in 2002? It looks pieced together.....any help would be appreciated. thanks

    What sort of activity is it showing after the charge-off date? Actual additional charges, or just accumulating interest and fees?
    Do you have enough information to determine if the balance due is correct and consistent with the contract?

    the amount couldn't be exact............we're talking about a balance of less than 900 dollars blown up to close to 3000. that is beyond crazy...if they think that is legal. but the last one that i got from them (statement) was around four or five months from co date.

    4 or 5 months before CO, or 4 or 5 months after CO?

    The OC sent the verification, or did the OC provide the verification through the CA?

    There is a major difference... :)

    Check out the Wollman Opinion.

    It is the CA's responsibility to obtain and mail the validation, if the OC sends it directly it is not a response to the validation request. The major exception would be if the OC recalled the account back from the CA when it was disputed, which can happen.

    creditdiva said the CO was in 2002, the statements provided were dated in 2003-2004... so it would be months after the CO date.

    Without statements starting from the CO date forward to account for arriving at the current balance, there is no way to know what the correct current balance should be. Notify the CA that there is a gap in the validation they provided, and that you need a complete accounting for how they arrived at the current balance. List the time period for which there are no statements. If their figure is legitimate, they may at least substantiate it.

    If they are fabricating the later statements, or have added unallowed fees but not shown them, you will call their bluff. Bluffs should be called.

    thanks.........my mind is telling me that the OC sent it....because like i said...the online pay has the oc's web address. i will have to call the number on a pay phone tomorrow to see what is up with the number. If that is the case.....it being the ca......that is........i will send them another dv letter and the wollman letter (am i right about the correct letter to send?)

    oc did in fact send me the statements. i got another packet in the mail where they showed all statements from the day one to the last statement that i ever received. but i thought that you also should have a signed contract included in that. so what should i do?
