Lexington Law Firm, a credit repair firm that advertises on this page, used to distribute a PDF file for free, for those that wanted to repair their own credit. Here it is if anyone cares to read it. http://www.ultimatebattles.com/credit4.pdf You will notice that in here, they make the same claims I do. Namely, you need to get rid of the included in BK items first. They also suggest the "paper relocation" tactic. I would add that having residence in multiple states in order to gain legal shelters is not against the law either. Virutally every president since Washington has done the same thing. Lexington BTW has removed 624 Bankruptcies last quarter. Along with 7,267 "included in BK" items. Don't ever let anyone tell you it can't be done. We are out there doing it! It boils down to this. From a statistical standpoint, one in three disputes goes your way. period. If you add knowledge to random chance, you only increase those odds. If you follow the simple steps I suggest, (or those outlined in the Lexington document) and you haven't cleared your BK in two years, you haven't sent in a dispute letter every 60 days.
Oh, I think you would get more than that for forgery of court documents. Then there is the whole "not able to vote" thing, and the "felon" stamp on your drivers license for the rest of your life. **nod** I agree. Too risky for my blood. Even more so, since this five step plan works inside of two years without breaking the law: 1) Get the connected addy removed, along with any other factors that link you to the BK. 2) Get rid of the "included in BK" items. 3) Dispute the BK with all three. 4) When the first one drops (probably TransUnion) use it against the others. 5) When the second one drops, use them both agains the third.

To make sure I'm reading correctly...In NY all negative items fall off in 5 years or just items pertaining to BK? If someone moves they're address to NY does the NY time frame take effect or the time frame from the state that the negative item was incurred in?
In New York, the reporting limit for most negative items is 5 years. Charge offs, collections, etc. Public records are not affected by this, so the actual BK can be reported for the full 10. However, New Yorkers get the advatage in a BK case, because the "included in BK" items fall off in five.
This is nothing new to us here. Do a search here under "Judgments". It has been said here many times over the years, that to get a jdugment removed is basically the same process, starting with getting the address connected to the judgment removed first. That removes 1 of the 3 items used to match you to the judgment.
Let me back peddle here, actually. It seems the actual law is that New York State Residents only: Satisfied judgments 5 years from the date filed; paid collections 5 years from the date of last activity with original creditor. However, there was a good article here: http://www.experian.com/corporate/max/max012099c.html that showed how it could be applied to anything other than tax leins and BKs, but the page is no longer available.
So then my question is, if NY law is in regards to paid negative items, how do bk items fall off in 5 years if they aren't paid?

Yeah....but you guys are so good, you knew about the C&D cycle right? And how to challange and get an item reported as positive? I didn't think I needed to walk such an advanced student by the hand. This is my last post here. Dripping with people that won't ADD to the knowledge, but would rather hide some of it. 1) I had my own bk removed myself. so yes, I do agree that bks get removed all the time. In my situation, it was a simple dispute. 2)still really nothing new to the regulars here 3)nothing new still. But if it works, go for it.
