OK....I'm STEAMING mad. To make a long story short, EMCC is a CA that is handling a debt for Gateway. This started when they entered a tradeline on my TU report in March 2002. On March 28, 2002 I sent a validation request via certified mail. I went ignored. On May 9, 2002, I sent an estoppel letter via certified mail. I went ignored. They entered a hard inquiry on my TU report and removed the tradeline. Fast forward to Nov 2002. The tradeline resurfaced. This time on EQ. I faxed 2 to 3 intent to sue's, etc to get this removed. I also disputed with EQ. The CA never responded to my attempts to take care of this, they didn't respond to EQ's investigation and the item was removed. NOW TODAY.. I pulled my EQ report. It's BACK. Question: Should I even bother sending them an intent to sue over this $3000 debt or just file the court papers that I've had since March? What violations should I sue for? Any help is appreciated. I'm sick of dealing with these dirtbags. Thanks in advance.
I would sue them...and wait 5 business days + 3 or 4, and then threaten to sue EQ for not notifying you of reinsertion.
You know what?? I'm so pissed that I forgot all about EQ not notifying me. Quick question ..I have Credit Watch. Does their ALERT constitute them notifying me or do they have to send the notification via mail? Can I request the documentation provided that allowed them to reinsert?

If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. Didn't say anything about that in Creditwatch did it? LOL Yes, demand they provide the documentation or delete.

I'll give EQ until next week to furnish the info (which I'm sure they won't) and will take the appropriate action against them as well. As far as EMCC goes, you're right. I'm mailing off my filing papers tomorrow. I'm sick of their crap. Based on my first post, what violations do I have them on? Anyone?
