I am suing (small claims) Equifax in California.

did you sue Equifax Corp. or
    Equifax Information Services
and who was registered agent of service
    thanks!

The person I stated on the actual small claims suit was:

    EQUIFAX
    Thomas Chapman, CEO and Chairman
    1550 Peachtree ST
    Atlanta, GA 30309

However, the person it was served to was:

    EQUIFAX Credit Information Services, INC
    Agent Prentice Hall Corp
2730 Gateway Oaks Dr Suite 100
    Sacramento, CA 95833

A person from Atlanta, GA actually showed up.. I ended up settling out of court right before the trial itself.

    Good luck!

I read your other thread BTW.. what I would suggest doing is after you file your lawsuit, attach a copy of the lawsuit you file and send them a letter offering to settle. Then followup with that and hope that someone calls you from their office.

Otherwise, expect that it is going all the way to court like mine did.. however, I was able to settle out of court on the day of the actual case.

I would also recommend that if you are suing more than one CRA, set the dates for different days.. meaning one CRA battle in court per day. Good luck!

    thanks!
ok as soon as i file i will draft a settlement offer.
I really don't want to go to court, but I do have
three folders of paper trail on same accounts for
    the last year.
If you don't mind would you share about the case
you won, how did you present the evidence? i am
afraid it will get confusing its 6 tradelines which were
transfered several times, re aged ect.

I lost with one of the CRA's, I settled with another, and won another one in court. The one I lost against I am goin to sue again SOON.. I have a ton of letters that even back up everything I say.. before I just had validation, estoppel. I got an unsympathetic judge that I said I was trying to take out the messenger, not the actual source.

The second time, I got a more sympahetic judge and won in court and got all tradelines and a monetary reward as well..

The 3rd CRA I ended up settling out of court.. so now I am left with 2 100% clean reports (one of them however has a judgement which is legitamate and I am removing this by trying to get it vacated first) and the final CRA I am going to sue again..

As for presenting your case, you are going against a big bad corporation.. that's what favors you and why small claims is good. However, best objective is to settle out of court and get it taken care of that way.. good luck and let us know how it goes!
