I have a paid CC charge-off being reported inaccurately (duplicate acct on EX, inaccurate "currently past due" note on EX, inaccurate "paid by co-signor" note on TU and EX). I started by disputing with all 3 bureaus. All 3 came back with the inaccurate info verified. I then disputed the inaccurate info directly with the OC on July 9. At the same time I also disputed again with TU and EX. The OC verified again with TU on July 17. The OC also verified the inaccurate info again with EX on July 16. These verifications were AFTER my OC dispute. The OC also failed to note any report with "consumer disputes". So, do I need to wait 30 days from the date I disputed with the OC (July 9) before I threaten to sue? Since I already have confirmation from EX and TU that the OC verified after my OC dispute, I'm wondering if I need to wait. Of course, I will wait if I have to. Any thoughts? Thanks a lot, Scrivener
You dont have to wait. You dont even have to write a letter. You can sue right away. Are you going to sue the OC? or the CRAs? or both. If they are reporting it inaccurately and verified it you might as well Send an intent to sue letter along with a settlement letter. ie I aggree not to sue you if you delete this account.. There is no time frame though on when you have to wait to sue or wait to send another letter. Most of it is personal preferance on which tactics you use. I would usually send two letters of dispute to the OC and CRA and then an intent to sue to both afterwards just to build a paper trail. Kev
